Terms of Use

The agreement

These terms are an agreement between you and Baobab Tree LLC ("we", "us"), which runs Understory (https://understory.garden). By using Understory you agree to them and to our Privacy Policy. If you don't agree, please don't use Understory.

The service

Understory helps you plan a garden: planting calendars, companion planting suggestions, pest and disease notes, and saved plans with a Garden Script to follow through the season.

Understory is currently free. We may add paid features in the future. We'll never charge you unless you choose to sign up for a paid feature, and we'll show you the price and terms before you do.

We're always improving Understory, so features may change, and we may suspend or stop parts of the service. If we ever shut Understory down, we'll give you reasonable notice so you can print or copy your plans.

Your account

• You must be at least 13 (or older, if your country requires it) to create an account.
• Use a real email address you can access, and keep your password to yourself. You're responsible for what happens in your account.
• Tell us at hello@understory.garden if you think someone else has accessed your account.
• You can delete your account at any time from your plans page.

Your plans

The garden plans you create belong to you. You give us permission to store, process and display them to you, only as needed to run Understory for you. Your plans are private to your account.

Fair use

Please don't:

• break the law using Understory, or use it to harm others;
• try to access other people's accounts or data, or get around our security;
• overload the service, or use bots or scripts to scrape or copy it, including the plant catalog, frost dates or images;
• copy, resell or republish Understory or its content as your own product or service;
• reverse engineer the app, except where the law allows it.

We may suspend or close accounts that break these rules.

Our content

Understory's name and logo, the app, its design, the plant catalog and guidance, the plant illustrations and our frost-date compilations belong to us or the people we license them from. You may use them for your own personal, non-commercial gardening, including printing your Garden Script and sharing it with your household and friends.

Some data comes from third parties under their own licenses, credited at the bottom of the pages that use it (NOAA, Copernicus, the Met Office and GeoNames).

About the gardening advice

Understory's information is general guidance to help you plan. It is not a guarantee of results.

• Frost and planting dates are estimates based on long-term climate averages. Actual weather varies from year to year and from one garden to the next, so check your local forecast before planting out tender plants.
• Results depend on your soil, sun, water, varieties, pests and many other things outside our control.
• Pest and disease notes are general. If you use any treatment, follow its label and your local rules.
• Some plants, or parts of them, are harmful to people or pets. Understory is not a guide to what is safe to eat or touch. When in doubt, ask a local expert such as your extension service.

We are not responsible for crop losses, damage or other consequences of decisions you make using Understory.

No warranties

Understory is provided "as is" and "as available". To the extent the law allows, we make no promises that it will always be available, error-free or accurate, and we disclaim all implied warranties, such as fitness for a particular purpose.

Limitation of liability

To the extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost data, profits or harvests. Our total liability to you for any claim about Understory is limited to the greater of the amount you paid us in the 12 months before the claim, or US $50.

Nothing in these terms limits rights you have under consumer laws that can't be waived, or our liability where the law doesn't allow it to be limited.

Ending things

You can stop using Understory and delete your account at any time. We may suspend or end your access if you break these terms or if we have to for legal reasons. The sections on our content, the gardening advice, warranties, liability and governing law continue to apply after that.

Governing law

These terms are governed by the laws of the State of New Jersey, USA, and disputes will be handled by the courts there, unless the consumer laws of the country you live in give you the right to have them handled under your local laws or in your local courts.

Changes to these terms

We may update these terms as Understory grows. We'll post the new version here and update the date at the top. If the changes are significant, we'll let you know by email or in the app before they take effect. If you keep using Understory after that, the new terms apply.
